OgTemplate.com respects the intellectual property rights of all creators and content owners. This Digital Millennium Copyright Act (DMCA) Policy explains how we handle copyright infringement claims in connection with our website and Android application. We are committed to responding promptly and appropriately to all valid copyright notices in accordance with the DMCA and applicable copyright law.


1. What Is the DMCA

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to request the removal of infringing content from online platforms. Even though OgTemplate.com is based in India, we voluntarily comply with DMCA procedures as an internationally recognised standard for handling copyright complaints. We also comply with the Indian Copyright Act, 1957 and its amendments.

OgTemplate.com operates as a template discovery platform — we provide links to CapCut templates and do not host or store template files directly on our servers. However, we take all copyright concerns seriously regardless of whether content is hosted directly by us or linked from our Platform.


2. Designated Copyright Agent

OgTemplate.com has designated an agent to receive copyright infringement notices. All formal DMCA notices must be sent to our Designated Agent using the contact information below. Please do not send general enquiries to this contact — it is strictly for copyright infringement notices only.

3. How to Submit a Copyright Takedown Notice

If you are a copyright owner or are authorised to act on behalf of a copyright owner, and you believe that content on OgTemplate.com infringes your copyright, you may submit a written takedown notice to our Designated Agent. To be valid and actionable, your notice must include all of the following information:

  • Your full legal name and complete contact information including mailing address, telephone number, and email address.
  • A clear description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notice, please provide a representative list.
  • The exact URL(s) on OgTemplate.com where the allegedly infringing content is located. General descriptions are not sufficient — you must provide the specific page address(es).
  • A statement of good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • A statement of accuracy that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the copyright owner’s behalf.
  • Your physical or electronic signature. An electronic signature — such as typing your full legal name at the bottom of the notice — is acceptable.

Notices that are incomplete or that do not meet all of the above requirements may not be processed. Please send your completed notice to thesparksofficials@gmail.com with the subject line “DMCA Takedown Notice — OgTemplate.com”.


4. What Happens After You Submit a Notice

Upon receipt of a valid and complete DMCA takedown notice, OgTemplate.com will take the following steps:

  • We will acknowledge receipt of your notice within a reasonable timeframe — typically within 2 to 3 business days.
  • We will review the notice to confirm it meets all DMCA requirements.
  • If the notice is valid, we will remove or disable access to the allegedly infringing content as promptly as reasonably practicable — typically within 48 to 72 hours of validation.
  • We will notify the user or account associated with the removed content that their content has been taken down and the reason for the removal.
  • We will keep a record of all valid notices received and actions taken in response.

Please note that if the infringing content is hosted directly on CapCut’s platform and not on OgTemplate.com’s servers, we will remove the associated link or listing from our Platform and recommend that you also submit a separate notice directly to CapCut through their official copyright reporting channel.


5. Counter-Notice Process

If you believe that content removed from OgTemplate.com in response to a DMCA notice was removed as a result of a mistake or misidentification, you may submit a counter-notice to our Designated Agent. A valid counter-notice must include all of the following:

  • Your full legal name and complete contact information including mailing address, telephone number, and email address.
  • Identification of the content that was removed and the URL at which it previously appeared on OgTemplate.com.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of a mistake or misidentification of the material to be removed.
  • A statement that you consent to the jurisdiction of the appropriate court for your region and that you will accept service of process from the person who provided the original DMCA notice.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notice, OgTemplate.com will forward a copy to the original complaining party and inform them that the removed content may be restored after 10 to 14 business days unless the complaining party files a court action against you and notifies us during that period. If no such court action is filed and we are notified accordingly, we may restore the removed content at our sole discretion.


6. Repeat Infringer Policy

OgTemplate.com has a strict policy against repeat copyright infringers. In accordance with the DMCA and our commitment to protecting intellectual property, we will terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is any user who has had two or more valid DMCA takedown notices filed against content they are responsible for on our Platform.

Upon a first valid infringement notice linked to a user account, we will issue a warning and remove the infringing content. Upon a second valid notice linked to the same account, that account will be permanently suspended and all associated content removed from our Platform. We reserve the right to terminate accounts immediately and without warning in cases of egregious or deliberate copyright infringement.

This policy is actively enforced and is a condition of use of OgTemplate.com for all registered users.


7. False or Abusive Notices

Submitting a DMCA takedown notice is a serious legal action. Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that content is infringing — or that content was removed by mistake — may be liable for damages, including costs and legal fees incurred by OgTemplate.com or the affected user.

OgTemplate.com reserves the right to report abusive, fraudulent, or bad faith DMCA notices to the appropriate authorities. If you are unsure whether the content you are reporting actually infringes your copyright, we strongly recommend consulting a qualified intellectual property attorney before submitting a notice.


8. Safe Harbor Statement

OgTemplate.com operates as an Online Service Provider (OSP) as defined under Section 512 of the DMCA. We qualify for safe harbor protection from copyright infringement liability provided that we comply with the DMCA’s notice and takedown procedures, which we are committed to doing. Our safe harbor protections are maintained by:

  • Designating and publishing contact information for a copyright agent to receive infringement notices.
  • Promptly removing or disabling access to content upon receipt of a valid and complete takedown notice.
  • Implementing and enforcing a repeat infringer termination policy.
  • Not interfering with standard technical measures used by copyright owners to identify and protect their works.

We do not financially benefit directly from infringing content and do not have actual knowledge of specific infringing material unless notified through the process described in this policy.


9. Changes to This DMCA Policy

OgTemplate.com reserves the right to update or modify this DMCA Policy at any time. When changes are made, we will update the “Last Updated” date at the top of this page. We encourage you to review this page periodically to stay informed of any updates. Your continued use of OgTemplate.com after any changes are posted constitutes your acceptance of the revised policy.
